This Privacy Policy explains how TastingRoom.ai collects, uses, discloses, stores, and protects personal information.

TastingRoom.ai is operated by 18018669 Canada Inc. In this Privacy Policy, “TastingRoom.ai,” “we,” “us,” and “our” refer to 18018669 Canada Inc. and the TastingRoom.ai service.

TastingRoom.ai is an AI-powered customer engagement and recommendation application for wineries and related merchants. The Service may be made available through a supported commerce platform such as Commerce7 or Shopify and may include our AI concierge, customer taste profiles, recommendations, feedback tools, dashboards, integrations, customer communications, and related functionality.

This Privacy Policy applies to personal information handled by TastingRoom.ai. Commerce platforms and wineries using TastingRoom.ai maintain their own privacy practices and policies.

1. Our Role

TastingRoom.ai processes different types of personal information depending on how an individual interacts with the Service.

Winery customers

For individuals who are customers of a winery using TastingRoom.ai, we generally process personal information on behalf of the winery.

For example, a winery may use TastingRoom.ai to:

  • Provide personalized wine recommendations
  • Collect customer feedback
  • Build or update customer taste profiles
  • Assist customers with wine selection
  • Provide product, pairing, cellaring, or reorder suggestions
  • Support post-purchase or re-engagement communications
  • Personalize customer interactions

Customer information may be provided to us through the winery’s account on a supported commerce platform (such as Commerce7 or Shopify) or collected directly when a customer interacts with the TastingRoom.ai concierge.

The winery remains responsible for its relationship with its customers, including its privacy notices, marketing practices, and obtaining any consent or other authority required by applicable law.

Winery users and other direct interactions

We may also collect personal information directly from winery owners, employees, administrators, prospective winery customers, website visitors, and other individuals who interact directly with TastingRoom.ai.

For this information, TastingRoom.ai may act as the organization responsible for determining how and why the information is processed.

2. Personal Information We Process

The information we process depends on the winery’s configuration of TastingRoom.ai and the information available through the winery’s commerce platform or directly provided to the Service.

Information received from a commerce platform or a winery

We may process information such as:

  • Customer name
  • Email address
  • Customer identifier
  • Order and purchase history
  • Products purchased
  • Product and inventory information
  • Customer tags or other relevant customer information
  • Customer feedback, ratings, or tasting comments
  • Wine preferences
  • Taste profile information
  • Recommendation, reorder, and cart activity
  • Information reasonably necessary to connect customer activity with the appropriate winery customer record

We seek to process only information reasonably necessary to provide the applicable TastingRoom.ai functionality.

Information provided through the concierge

When a customer interacts with the TastingRoom.ai concierge, we may process:

  • Conversation messages
  • Questions and requests
  • Wine preferences
  • Feedback about wines
  • Food, occasion, or product preferences shared during the conversation
  • Recommendation responses and interactions
  • Other information the individual chooses to provide during the conversation

Conversation information may be used to provide the current interaction and, where enabled by the winery, to update or improve that customer’s taste profile and future recommendations.

Customers should avoid providing sensitive personal information that is not relevant to their interaction with the winery or the Service.

Information from winery users

When a winery owner, employee, or administrator interacts with TastingRoom.ai, we may process:

  • Name
  • Business or winery name
  • Business email address
  • Role or permissions
  • Service configuration information
  • Support requests and communications
  • Usage and activity information relating to the Service

Where account, subscription, or payment functions are administered through a commerce platform such as Commerce7, the applicable information may be handled directly by that platform rather than TastingRoom.ai.

Website and technical information

When our website or Service is used, we may automatically receive limited technical information such as:

  • IP address
  • Browser and device information
  • Log information
  • Pages or features accessed
  • Referring information
  • Approximate location derived from IP address
  • Service performance and error information
  • Cookie or local-storage information where applicable

3. How We Use Personal Information

We use personal information as reasonably necessary to provide and operate TastingRoom.ai, including to:

  • Provide AI concierge conversations
  • Generate personalized wine recommendations
  • Build and update customer taste profiles
  • Remember customer preferences
  • Process customer feedback
  • Provide product, reorder, pairing, cellaring, or other wine-related suggestions
  • Support cart-building and purchasing experiences
  • Personalize future interactions with the winery
  • Support winery-authorized customer communications
  • Connect information with the appropriate commerce-platform customer or order
  • Provide dashboards and customer insights to wineries
  • Operate and maintain integrations with supported commerce platforms such as Commerce7 and Shopify
  • Provide support to winery users
  • Monitor and secure the Service
  • Detect and troubleshoot errors
  • Prevent misuse, fraud, or unauthorized access
  • Maintain and improve the functionality and reliability of the Service
  • Comply with legal obligations
  • Enforce our Terms of Service

We do not use identifiable winery customer information for unrelated advertising or to independently market products or services to a winery’s customers.

4. AI, Taste Profiles, and Personalization

TastingRoom.ai uses artificial intelligence to generate responses, recommendations, summaries, insights, and other outputs.

Taste profiles

Where enabled by the winery, TastingRoom.ai may create or maintain a customer taste profile.

A taste profile may summarize information such as:

  • Wines or styles a customer likes or dislikes
  • Feedback about previous purchases
  • Preferred grape varieties or wine characteristics
  • General flavour or style preferences
  • Purchase history relevant to recommendations
  • Preferences learned through concierge conversations

The taste profile may be used to personalize recommendations and future interactions with that winery.

Taste profiles are intended to improve wine-related customer experiences. They are not intended to determine eligibility for employment, credit, insurance, health care, housing, or other decisions that produce similarly significant effects.

AI processing

Information relevant to a customer request may be processed by artificial intelligence infrastructure providers in order to generate responses and recommendations.

AI-generated recommendations may not always be accurate, complete, or appropriate for every customer.

Model training

We do not use personal information processed through TastingRoom.ai to train general-purpose AI models.

Our AI infrastructure providers process information supplied to them for purposes such as generating responses under commercial arrangements intended to restrict use of that information to train their general-purpose models.

5. Consent and Winery Responsibilities

We collect, use, and disclose personal information with consent where required by law or as otherwise permitted or required by applicable law.

Where TastingRoom.ai processes information on behalf of a winery, the winery is responsible for providing any required privacy notices and obtaining any consents or other authority required by applicable law for its use of TastingRoom.ai.

Depending on the circumstances, this may include requirements relating to:

  • Personalized recommendations
  • Taste profiling
  • Customer feedback
  • Marketing communications
  • Post-purchase communications
  • Re-engagement communications
  • Connected customer and order information

Individuals may withdraw consent where permitted by law, subject to applicable legal or contractual restrictions. Withdrawal may affect the availability of functionality that relies on the relevant information, such as personalized recommendations.

6. Customer Communications

Wineries may use TastingRoom.ai to create, personalize, trigger, or support communications relating to their customers.

These may include communications concerning:

  • Recent purchases
  • Customer feedback
  • Wine recommendations
  • Reorders
  • New releases or other winery products
  • Customer preferences and taste profiles

The winery remains the sender or responsible business for its customer communications unless expressly stated otherwise.

The winery is responsible for ensuring that its communications comply with applicable marketing and anti-spam laws, including requirements relating to consent, sender identification, and unsubscribe functionality.

Where TastingRoom.ai directly provides functionality used to manage communication preferences or unsubscribe requests, we will process those preferences as reasonably necessary to provide the Service.

7. How We Disclose Personal Information

We may disclose personal information only as reasonably necessary to provide, operate, secure, and support TastingRoom.ai or where otherwise permitted or required by law.

This may include disclosure to:

  • The winery associated with the customer
  • The winery’s commerce platform (such as Commerce7 or Shopify)
  • Hosting and infrastructure providers
  • AI infrastructure providers used to generate responses and recommendations
  • Email or communication providers where applicable
  • Analytics, monitoring, logging, or security providers
  • Support and operational service providers
  • Professional advisors such as lawyers, accountants, or insurers
  • Authorities, regulators, courts, or other parties where required or permitted by law
  • A buyer, investor, lender, or successor in connection with a proposed or completed corporate transaction

Service providers that process personal information on our behalf are expected to use it only for the services they provide to us and to protect it through appropriate contractual, technical, or organizational measures.

A current list of material subprocessors used to provide TastingRoom.ai is available on request.

We do not sell personal information.

8. Commerce Platforms and Third-Party Services

TastingRoom.ai integrates with supported commerce platforms, such as Commerce7 and Shopify, in order to provide functionality to participating wineries.

When a winery authorizes TastingRoom.ai, information may be received from or sent to the winery’s commerce platform as necessary to provide the enabled functionality.

Commerce platforms operate independently from TastingRoom.ai and maintain their own terms and privacy practices.

TastingRoom.ai may also rely on other service providers for infrastructure, artificial intelligence, communications, security, monitoring, or related functionality.

Those providers may process limited personal information as necessary to provide their services to us.

9. Cookies and Local Storage

TastingRoom.ai may use cookies, browser storage, and similar technologies where necessary to operate our website or Service.

These may include:

  • Necessary technologies used for authentication, security, session management, and Service operation
  • Functional technologies used to maintain an ongoing concierge interaction or remember limited Service state
  • Analytics or performance technologies, where used, to understand Service performance and usage

Where required by applicable law, consent will be requested before non-essential cookies or similar technologies are used.

Browser settings may allow individuals to block or delete cookies or stored information. Doing so may affect some Service functionality.

A winery’s website may also use its own cookies or technologies, including those provided by its commerce platform or other third parties. Those technologies are governed by the winery’s and applicable provider’s privacy practices.

10. Where Information Is Processed

TastingRoom.ai uses service providers and technology infrastructure that may operate in Canada, the United States, or other jurisdictions.

As a result, personal information may be stored or processed outside the province, state, or country in which an individual resides.

Information processed in another jurisdiction may be subject to the laws of that jurisdiction, including lawful access requirements applicable to service providers operating there.

We use reasonable contractual, technical, and organizational measures intended to protect personal information processed by our service providers.

11. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected or processed, including to provide the Service, maintain security, comply with legal obligations, resolve disputes, and enforce agreements.

Retention periods vary depending on the type of information and how the winery has configured and used TastingRoom.ai.

When a winery’s subscription or use of TastingRoom.ai ends, customer information processed on its behalf will generally remain available for export on reasonable request for up to 30 days.

After that period, we may delete, return, or anonymize the information, except where limited retention is reasonably necessary for:

  • Legal or regulatory requirements
  • Security
  • Fraud prevention
  • Dispute resolution
  • Backup and disaster-recovery processes

Information remaining temporarily in backups will be protected and removed in accordance with normal backup-retention processes.

12. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information against risks such as unauthorized access, collection, use, disclosure, alteration, loss, or destruction.

These safeguards may include access controls, authentication, encryption, infrastructure security, monitoring, and contractual protections with service providers, as appropriate to the nature of the information and Service.

No electronic system can be guaranteed to be completely secure.

If we become aware of a security incident affecting personal information processed on behalf of a winery, we will investigate the incident, take reasonable steps to contain and remediate it, and notify the affected winery without undue delay where appropriate.

We will provide reasonable information and assistance to support applicable notification or reporting obligations.

13. Access, Correction, Deletion, and Privacy Requests

Depending on applicable law and the circumstances, individuals may have rights relating to personal information about them, including the ability to:

  • Request access to personal information
  • Request correction of inaccurate or incomplete information
  • Ask for information about how their information is being used
  • Request deletion of personal information where applicable
  • Request correction or deletion of a taste profile
  • Withdraw consent where applicable
  • Ask questions about personalized recommendations or profiling

Winery customers

If you are a customer of a winery using TastingRoom.ai, the winery generally controls your customer relationship and associated information.

You may therefore wish to submit a privacy request directly to the winery.

If you submit a request to TastingRoom.ai concerning information that we process on behalf of a winery, we may refer the request to that winery or work with the winery to respond.

Direct requests to TastingRoom.ai

For information that TastingRoom.ai controls directly, you may contact us using the information in Section 18.

We may need to verify your identity before fulfilling a request.

Privacy rights are subject to applicable legal exceptions and limitations.

If you are not satisfied with our response, you may have the right to contact the privacy regulator responsible for your jurisdiction.

14. Children and Legal Drinking Age

TastingRoom.ai is designed for use in connection with wineries and wine-related products and is intended for adults of legal drinking age.

The Service is not intended to market alcohol to children or individuals who are not legally permitted to purchase alcohol.

Wineries remain responsible for applicable age screening, age verification, alcohol advertising, and alcohol marketing requirements on properties and communications they control.

We do not knowingly seek to collect personal information from children through TastingRoom.ai.

If we become aware that personal information has been collected from a child in circumstances where it should not have been collected, we will take reasonable steps to delete or otherwise appropriately address the information.

15. Aggregated and De-Identified Information

We may create and use aggregated or de-identified information for purposes such as:

  • Understanding how TastingRoom.ai is used
  • Measuring Service performance
  • Developing and improving functionality
  • Analyzing trends
  • Creating aggregate benchmarks

Aggregated or de-identified information used for these purposes will not be intended to identify an individual.

We will not attempt to re-identify de-identified information except where reasonably necessary for security, testing, or another purpose permitted by applicable law.

16. Business Transactions

If TastingRoom.ai or 18018669 Canada Inc. is involved in a merger, acquisition, financing, reorganization, sale of assets, or similar corporate transaction, personal information may be disclosed or transferred as part of that transaction.

Where applicable, we will use reasonable safeguards and comply with legal requirements relating to such a transfer.

17. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to TastingRoom.ai, our service providers, our data practices, or applicable requirements.

If we make material changes, we may provide notice through our website, TastingRoom.ai, the winery’s commerce platform, email, or another reasonable method.

The “Last updated” date at the top of this Privacy Policy identifies the date of the most recent revision.
